JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Obra P.S. Case No. 27 of 2015 registered for the offence under Sections-307, 504/34, 341, 323, 324 of the Indian Penal Code.
Taking into consideration that petitioner is said to have used dagger, causing simple injury to the informant, I am not inclined to extend the privilege of anticipatory bail to the petitioner bail and accordingly, his prayer for anticipatory bail of the petitioner in connection with Obra P.S. Case No. 27 of 2015 pending in the court of Learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad/concerned court stands
Patna High Court Cr.Misc. No.26464 of 2015 (2) dt.17-07-2015 2/2 disposed off with direction to the petitioner to surrender in the court below and to seek regular bail in connection with Obra P.S. Case No. 27 of 2015 within four weeks from today and if, the petitioner does so, the concerned court shall consider the regular bail application of the petitioner on the date of his surrender on its own merit, without being prejudiced by this order, particularly, keeping in mind that there is case and counter case between the parties and at best, only Section-324 of the Indian Penal Code is attracted against the petitioner.
