2. Petitioner seeks regular bail in connection with Vaishali (Belsar O.P.) P. S. Case No. 279 of 2021 in a case registered for the offence punishable under Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 2453.400 liters of foreign liquor were recovered from two vehicles.
4. Learned counsel for the petitioner submits no incriminating material has been recovered from the conscious possession of the petitioner and she is no way connected with the aforesaid recovery. She is innocent and has committed no offense. She has been falsely implicated in this case only on suspicion. She has given the vehicle in question to one Siraz
Patna High Court CR. MISC. No.41564 of 2025(2) dt.08-08-2025 2/2 Ahmed on monthly rent and has no knowledge that the same has been used in transportation of illegal liquor. Petitioner is a lady and is in custody since 29.04.2025 Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise-II, Vaishali in connection with Vaishali (Belsar O.P.) P. S. Case No. 279 of 2021.
