The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 25(1B)a/26/35 of the Arms Act. On informant that the miscreants are preparing to commit dacoity, the raid was led leading to arrest of co-accused Shailendra Prasad @ Lulha @ Shadhu. The name of the petitioner sprang up in the confession of co-accused as a person escaped from the scene.

It is submitted by learned counsel for the petitioner that since the petitioner has land dispute with the apprehended coaccused, hence, his name sprang up in his confession. The aforesaid facts constitute good ground for

Patna High Court Cr.Misc. No.26357 of 2015 (2) dt.20-07-2015 2/2 consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bhagwanpur P.S. Case No.191 of 2014, pending before the learned Judicial Magistrate, 1st Class, Siwan.

With the above observation, this application is, accordingly, disposed off.
