The petitioner is apprehending his arrest in connection with Rail Darbhanga (Sitamarhi) P.S. Case No. 58 of 2019 for the offence registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that he has no connection with the said Tara Enterprises from which the alleged parcels are said to have arrived. . He further submits that he has also not aware under what circumstances such seizure was made as he has not received any such parcel. He further submits that the petitioner may be extended the privilege of bail.

No.37446 of 2019(3) dt.22-08-2019 2/2 Considering the aforesaid facts and circumstances of the case and the alleged recoveries were not made from the conscious possession of the petitioner and rather the same is in the name of Sharma Picture Palace, Main Road, Sitamarhi, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.D.J.-II-cumSpecial Judge, Excise Act, Sitamarhi in connection with Rail Darbhanga (Sitamarhi) P.S. Case No. 58 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
