The petitioners, who are the employees of the District Rural Development Agency, Madhepura (In short 'DRDA'), have approached this Court seeking a direction upon the respondents to absorb their services in any other Department of the State of Bihar in terms of the resolution issued by the Rural Development Department as contained in Memo No. 6479 dated 27.07.2009.

The claim of the petitioner at the outset refuted by the learned Advocate for the DRDA that since the petitioners were admittedly the employees of the Agency, no absorption of the petitioner can be made in the Department of State nor they are entitled to receive the pensionary benefits like pension, gratuity etc in terms of letter No. 379881 dated 19.07.2018.

At this stage, learned Advocate for the petitioner contended that the issue with regard to absorption of the identically situated persons of the Agency and extending other benefits at par with the Government employees are pending consideration before the Hon'ble Supreme Court in Special Leave to Appeal No. 26180 of 2024.

5. Considering the submissions advanced on behalf of the petitioners, the present writ petition stands disposed of with a liberty to the petitioners that in case any relief is granted to the
