JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioner is apprehending his arrest in connection with Khagaria(Muffasil) P.S. Case No. 710 of 2014 for the offences instituted under Sections 341, 323, 504, 506, 357, 307, 376 and 313/34 of the IPC.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the co-accused Dhurub Kumar established physical relationship with the daughter of the informant and he threatened him not to disclose the fact and further got the daughter of the informant aborted by administering tablet when the informant knew this fact by the accused persons including the petitioner to the informant not to raise alarm and further co-accused Dhurub Kumar and this petitioner assaulted the informant and petitioner and others took out Rs. 2000/- from the
Patna High Court Cr.Misc. No.27872 of 2015 (2) dt.22-07-2015 2/2 informant.
It has been submitted on behalf of the petitioner that the main allegation is against Dhurub Kumar who is said to have established physical relationship with the daughter of the informant. It is further submitted that as far as allegation of assault is concerned, it is alleged that the petitioner had assaulted on the knee of the informant but from perusal of the injury report it appears that there is no such injury on the knee of the informant. It is further submitted that the petitioner has got no criminal antecedent.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Khagaria (Muffasil) P.S. Case No. 710 of 2014 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
