Petitioner seeks bail in connection with Baisi P.S. Case No. 169 of 2016 registered under Sections- 273 of the Indian Penal Code and section 30(a), 28 (1) of Bihar Prohibition and Excise Act, 2016 Recovery of illegal wine has been made from the house of the petitioner.

Learned counsel for the petitioner submits that the aforesaid recovery has not been made from the conscious possession of the petitioner. It is further submitted that petitioner has clean antecedent. Petitioner is in custody since 10.10.2016.

Patna High Court Cr.Misc. No.54014 of 2016 (2) dt.16-12-2016 Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Purnea in connection with Baisi P.S. Case No. 169 of 2016.
