ANJANA PRAKASH ORAL JUDGMENT Date: 26-02-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks quashing of the order dated 25.8.2014 passed in Tr. No. 2973 of 2014, arising out of Complaint Case No. 509 of 2012 by which the Magistrate has cancelled the bail bond of the Petitioner and issued warrant of arrest. It has been submitted that the Complainant is now living with the Petitioner and, therefore, the Proceeding should also be dropped.

Considering that the Petitioner undertakes to be physically present on the next date and abide by the earlier condition, the order dated 25.8.2014 passed by the learned Judicial Magistratre,

Patna High Court Cr.Misc. No.1679 of 2015 dt.26-02-2015 2/2 1st Class, Muzaffarpur in Complaint Case No. 509 of 2012 arising out of Trial No. 2973 of 2014, is hereby set aside. The Court concerned is directed to summon the Complainant within a period of six weeks from the date of receipt of this order and if she supports the Petitioner that she wishes to withdraw the application, the Proceeding shall stand dropped in the interest of the Parties.
