JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Garkha P.S. Case No. 293 of 2016 registered for the offences punishable under Section 366(A)/34 of the Indian Penal Code. The petitioner is named in the F.I.R and the allegation against the petitioner is of keeping the minor girl. It has been submitted on behalf of the petitioner that as a matter of fact, there was love affair between the petitioner and the victim girl, but later on, the petitioner has falsely been implicated in this case and he is in custody since 28.09.2016. Heard the learned APP also.

Having heard both sides, in view of the fact that the

Patna High Court Cr.Misc. No.54720 of 2016 (2) dt.20-12-2016 2/2 statement of the victim girl recorded under Section 164 Cr.P.C. and allegation is against the petitioner, I am not inclined to grant bail to him and accordingly, his such prayer stands rejected in connection with Garkha P.S. Case No. 293 of 2016 pending in the court of learned Additional Chief Judicial Magistrate, V Saran at Chapra.

However, learned court below is directed to expedite the trial and conclude the same within nine months from the date of receipt / production of this order. (Vinod Kumar Sinha, J) ajaypd./- U T
