The petitioner seeks regular bail in connection with Chhatauni P.S. Case No. 207 of 2017 for the offences punishable under Section(s) 115/120B, 25(1-A), 25(1-AA), 25(1-B)A, 26,(ii) and 35 of the Arms Act.
The allegation is regarding the recovery of arms from the co-accused persons, namely, Deepak Kumar Paswan when he was apprehended by the police. The name of the petitioner has transpired in the present case upon confessional statement made by co-accused persons.
The learned counsel for the petitioner submits that apart from the confessional statement of the co-accused person, there is no material on record to suggest the complexity of the petitioner
Patna High Court Cr.Misc. No.24917 of 2018 (4) dt.28-05-2018 2/2 herein in the present matter. It is submitted that co-accused person from whom the arms have been recovered, i.e., Munna Pathak has been granted bail vide order dated 12.04.2018 immediately upon completion of one year of custody and the petitioner from whom, no arms has been recovered, is in custody since 22.09.2017. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, in connection with Chhatauni P.S. Case No. 207 of 2017.
