Petitioner seeks bail in a case registered for the offence punishable under Sections 5B(1), 5D, 6(a), 6(b), 3(i), 5, 5A, 5C of the Immoral Traffic Prevention (Amended) Act, 2006, and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 7 bottles each containing 750 ml. wine was recovered from the house of petitioner and on search of the residential hotel of the father of the petitioner, namely, Navin Kumar Jha four girls were found in objectionable condition with three persons who disclosed that the petitioner and his parents sends the customers for flesh trade by them and mother of the petitioner did not pay any money to the

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the aforesaid occurrence. The house of the petitioner is inhabited by several family members and he had no knowledge of keeping of the said liquor in the house. The chargesheet in the case has been submitted and parents of the petitioner, namely, Navin Kumar Jha and Manju Devi have been enlarged on bail by different coordinate Bench of this Court vide order dated 03.05.2018 passed in Cr. Misc. No.25825 of 2018 and order dated 21.05.2018 in Cr. Misc. No.29778 of 2018 respectively. He has no criminal antecedent. He has been languishing in custody since 05.03.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Ahiyapur P.S. Case No. 222 of 2018.
