The petitioners seek regular bail in connection with Jandaha PS case no. 310 of 2018 instituted for the offences punishable under Sections 302, 307 and other sections of Indian Penal Code, Section 27 of Arms Act, Section 3 of Explosive Substance Act and Sections 13,16,19,20 of Unlawful Activities Prevention Act.

The allegation is regarding the FIR named accused persons as well as some unknown accused persons having arrived at the house of the informant and having shot dead the brother of the informant.

No.42736 of 2019(3) dt.27-09-2019 2/2 The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and there is no allegation of any overt act as against the petitioners herein. The petitioners are stated to be having a fair antecedent except one case in which they are on bail. The petitioners are stated to be languishing in custody since 25.03.2019 and 11.03.2019 respectively. Lastly, it is submitted that similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court vide order dated 11.09.2019 passed in Cr. Misc. no. 38347 of 2019 Having regard to the facts and circumstances of the case, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Vaishali at Hajipur in connection with Jandaha PS case no. 310 of 2018.
