JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,307 and 376/511 of the Indian Penal Code. It is alleged that the petitioners along with other accused persons tried to take possession of the land when protest was made by the daughter in law and son of the informant namely Shobha Devi and Neeraj Sah respectively then accused persons tore the blouse of the daughter in law of the informant when the informant's son came to rescue his wife, petitioner no. 1 alleged to have assaulted the informant's son with butt of pistol. It

Patna High Court Cr.Misc. No.26846 of 2015 (2) dt.22-07-2015 2/2 is further alleged that petitioner nos. 2 and 6 tried to strangulate the younger son of the informant, namely, Dhiraj Kumar. Accused persons also took away the box containing cash and ornaments. It is submitted by the learned counsel for the petitioners that Neeraj Sah received simple injury when petitioners side lodged Sahebganj P.S. Case No. 235 of 2014 at earlier point of time and the petitioners side also received injury. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, West, Muzaffarpur in connection with Sahebganj P.S. Case No. 243 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
