The petitioner seeks bail in Kotwa P.S. Case No. 99 of 2016, registered for the offences punishable under Sections 413, 414 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that one Raju Ansari was arrested along with stolen motorcycle and on his disclosure other accused persons were arrested. Raju Ansari was arrested and he confessed that stolen tractor was kept near the house of the petitioner and on such the stolen tractor was recovered from in front of the house of the petitioner. Learned counsel for the petitioner submits that the petitioner was not present in his house and nobody has seen the petitioner committing theft. The tractor was recovered from the

Patna High Court Cr.Misc. No.54468 of 2016 (2) dt.10-01-2017 2/2 road and not from conscious possession of the petitioner. Other accused persons have already been enlarged on bail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, East Champaran at Motihari in Kotwa P.S. Case No. 99 of 2016.
