1. Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner apprehends his arrest in connection with Chhatapur P.S. Case No. 241 of 2022, registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code and 11 (D) (E) of Prevention of Cruelty to Animal Act.

3. As per allegation, the informant having got an information that some persons at village Harihpur, Kabir Chowk near Gas Godown had kept some animals tied up on a Bolero pick-up van, reached the place of occurrence, where he saw two white oxen, one black ox and two female calves tied with rope in that vehicle and on account of which the animals were

4. The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated in this case. He is a person of clean antecedent. As a matter of fact, the cattle loaded on the pick-up van were belonging to the petitioner and in this respect, the purchase receipt has been annexed with the record.

5. Considering the above-mentioned facts and circumstances, as well as the clean antecedent, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Supaul in connection with Chhatapur P.S. Case No. 241 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
