2. The petitioner apprehends arrest in connection with Dhanarua PS Case No.217 of 2025 dated 31.03.2025, instituted under Sections 115(2), 118(1), 109(1), 118(2), 126(2), 127(2), 190, 191(2), 191(3), 303(2) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in brief, is that on the alleged date of occurrence the petitioner along with other FIR named accused persons and three unknown persons entered into the house of the informant and assaulted her. It is also also alleged that Bigan Sao snatched jewellries of Rabita Devi, sister of the informant, and the petitioner attacked her by sharp weapon causing cut injuries on the ears.

4. Learned counsel for the petitioner submits that the FIR has been lodged against five persons including the petitioner. Allegation against the petitioner is that he assaulted the sister of informant by means of sharp weapon causing cut injury upon her ear. Learned counsel further submits that despite the repeated direction of the 1st District & Sessions Judge, Masaurhi, case diary as well as injury report were not made available before the concerned Court. Further submission is that there is no injury report available in the case diary. It is also submitted that both sides are closely related to each other. No occurrence as alleged has ever taken place. Lastly, it is submitted that the petitioner has no criminal antecedents.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Masaurhi, in Dhanarua PS Case No.217 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita,
