JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 The petitioners are apprehending their arrest in connection with Maniyari P.S. Case No. 57 of 2013 for the offences instituted under Sections 304(B)/34 of the I.P.C. Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that on 30.03.2013 the informant got information on mobile that his daughter has been killed by her matrimonial people and on getting this information, he reached there and found his daughter lying dead. He has further mentioned the name of petitioners alongwith other accused and stated that they killed his daughter for dowry and they previously also perpetrated torture upon her for fulfilling the demand of dowry, for which Complaint Case No. 79/2012 was also filed.

No.26691 of 2015 (2) dt.20-07-2015 2/2 It has been submitted on behalf of the petitioners that the petitioner nos. 1 and 2 are the Bhaisurs, petitioner no. 3 is the Nanad, petitioner nos. 4 and 5 are the Gotias of the deceased. It is further submitted that the petitioners are separate in mess and property with the husband of the deceased and they have no concern with the affairs of the husband of the deceased. It is further submitted that the petitioners have got no criminal antecedent. Other co-accused, i.e., mother-in-law and the fatherin-law have also been granted anticipatory bail by this Court vide Cr. Misc. No. 25848 of 2014.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Maniyari P.S. Case No. 57/2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
