Petitioners are accused in connection with Mohiuddinnagar P.S. Case No. 197 of 2015 registered under Sections 307 and other allied sections of the I.P.C. to which section 302 was added later on.

Learned counsel for the petitioners submits that petitioners have been implicated in this case due to enmity and grudge. There is no specific allegation of assault against these petitioners. Post mortem report does not corroborate the allegations levelled in the FIR. Petitioners have no criminal antecedent and are in custody since 24/29.09.2016. Similarly

Patna High Court Cr.Misc. No.54009 of 2016 (3) dt.15-02-2017 2/2 situated co-accused persons have been granted bail by this Court vide orders dated 31.03.2016 and 28.04.2016 passed in Cr. Misc. Nos. 12380 of 2016 and 11000 of 2016 respectively. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Samastipur in connection with Mohiuddinnagar P.S. Case No. 197 of 2015.
