2. The petitioner apprehends his arrest in connection with Hajipur Sadar P.S. Case No. 369 of 2023 registered under Section 409 of the Indian Penal Code.
3. It is alleged that in the letter no. 1214 dated 15.05.2023 of District Agriculture Office, Vaishali that the Adarsh Aarakshan Roaster Panji was not available due to which the appointment on the post of Kisan Salahkar could not be completed and at the relevant time, this petitioner was acting as clerk, and he was also the in-charge of Adarsh Aarakshan Roaster Panji, but after his transfer and retirement he did not
Patna High Court CR. MISC. No.45923 of 2024(2) dt.06-08-2024 2/3 hand over the charge, for which he was repeatedly directed.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. As a matter of fact, the petitioner was a clerk in the District Agriculture Office, Hajipur, Vaishali, and was transferred to the Sub-Divisonal Agriculture Office, Hajipur, and he handed over the charge on August 22, 2014, and his last pay slip was issued on October 28, 2014. It is further submitted that the Ideal Roaster Register in question is of the year 2010 but the Department did not take any action for the last 10 years, and after the retirement of the petitioner, this false and concocted case has been lodged. The petitioner has got no criminal antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case
