JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 01-08-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner as well as learned counsel for the informant.

The petitioner apprehends his arrest for the offences alleged under Sections 147, 149, 341, 323, 324, 307, 354(A), 504 and 506 of the Indian Penal Code, registered in connection with Dumpra P.S.Case No. 175 of 2021. As per allegation, accused persons named in the FIR including the petitioner came to the house of the informant and wanted the whereabouts of the informant. They started abusing the sister of the informant. Co-accused Harendra Kumar

Patna High Court CR. MISC. No.49997 of 2021(3) dt.01-08-2022 2/3 dragged the sister of the informant to the darwaza and attempted to outrage her modesty. The allegation against the petitioner is that he assaulted on the head of the informant with knife. The learned counsel for the petitioner has submitted that the petitioner is innocent. The case lodged by the defense side is earlier to the case lodged by the prosecution side. The family members of the defense side have also sustained injuries. He has submitted further that the allegation against the petitioner is that he assaulted the informant on head with knife and injury no.2 which is on his face has been opined as simple in nature. Though injury no.4 is grievous, but it is on right wrist of the informant and this injury is not attributed against the petitioner.

On the other hand, learned counsel for the informant has opposed the prayer for bail and submitted that there is specific allegation against the petitioner that he inflicted knife blow on the person of the informant.

Considering the above facts and circumstances and also considering the injury attributed to the petitioner which is simple in nature, and the case lodged by the defense side is earlier in time, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of

No.49997 of 2021(3) dt.01-08-2022 3/3 communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM I/C, Sitamarhi in connection with Dumpra P.S.Case No. 175 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
