JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-05-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Keoti P.S. Case No. 171 of 2017 for offenses under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioners have no criminal antecedent. No injury was found on the person of the deceased. In fact, deceased was suffering from old ailment of TB and Asthma. He submits that at best the instant case would be a case of culpable homicide not amounting to murder.
Considering the aforesaid facts and circumstances and the fact that the petitioners has remained in custody for nearly

Case No. 171 of 2017.
