Heard learned counsel for the petitioners and the State.

Petitioner seeks regular bail in Teghra P.S Case No. 84 of 2022 registered for the offences punishable under Sections 25(I-b)a, 26 and 35 of the Arms Act.

Allegedly, one live cartridge was recovered beneath a pillow on the bed of the petitioner and one country made pistol was recovered from the possession of co-accused Suraj Kumar. The main submissions advanced by learned counsel Shri Raghu Nath Singh appearing for the petitioner are that coaccused Suraj Kumar has been granted bail by the learned court

Patna High Court CR. MISC. No.40482 of 2022(2) dt.12-10-2022 2/2 below considering his plea of juvenility and only one cartridge is alleged to have been recovered from the possession of this petitioner and he has fair antecedent.

Sri Ram Sevak Choudhary, learned APP appearing for the State has opposed the prayer for bail. In view of the above submissions and considering the petitioner's custody period and also the fact that only one cartridge is alleged to have been recovered from the possession of this petitioner in the opinion of this court, a lenient approach can be taken in respect of the petitioner.

Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Miss. Mohini Kumari, Judicial Magistrate, Ist Class, Begusarai in Teghra P.S Case No. 84 of 2022.
