JUSTICE ARUN KUMAR ORAL ORDER 20-07-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant.. Petitioner, already in custody since 2.12.2017 seeks bail in Kochas (Pasathua) PS Case No. 178 of 2017 registered under Sections 341, 323, 307, 302, 120(B), 109, 504 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that on the exhortation given by the petitioner other accused persons shot dead the informant's father. Learned Counsel for the petitioner submits that there is some land dispute between both sides and the allegation against the petitioner is of giving exhortation, however no specific overt act is alleged against him, the allegation of shooting is against other accused persons, the petitioner has been in custody since 2.12.2017. Learned Counsel for the informant opposed the prayer for bail.
Having considered the said facts and circumstances, the petitioner, namely, Sita Ram Sah is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst, Rohtas at Sasaram in connection with Kochas (Parsathua) PS Case No. 178 of 2017.
