The petitioner seeks bail in connection with Kargahar P. S. Case No. 69 of 2020 dated 17.03.2020, instituted for offences under Sections 25(1-b)-a and 26 of the Arms Act, 1959 and Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Patna High Court CR. MISC. No.37721 of 2020(2) dt.05-02-2021 2/3 Two country-made rifles, one cartridge and 3 kgs. of Ganja is said to have been recovered from the roof-top of the house of the petitioner.

The learned counsel for the petitioner has submitted that the firearms and narcotics have been planted over the roof-top of the house of the petitioner for falsely implicating him.

He is in custody since 18.03.2020.

Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Rohtas at Sasaram, in connection with Kargahar P. S. Case No. 69 of 2020.

The petition stands allowed.

It is however made clear that the petitioner shall participate in the trial and his absence from the trial proceedings on two consecutive occasions without
