JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 04.08.2016 in connection with G.R. No. 2357 of 2016, arising out of Kuchaikot P.S. Case No. 161 of 2016, registered offences punishable under Section 302/34 of the Indian Penal Code and 27 of the Arms Act. It has been submitted on behalf of the petitioner that due to previous land dispute the alleged occurrence took place. The petitioner has assaulted the victim only by means of fist and slap and no further allegation is attributed against the petitioner and the allegation of firing is against other accused. The petitioner has no criminal antecedent and he has been languishing in jail since 04.08.2016.

Learned A.P.P. for the State also could not controvert the

Patna High Court Cr.Misc. No.53852 of 2016 (2) dt.15-12-2016 2/2 fact that save and except the assault by fist and slaps, there is nothing against the petitioner.

Considering the aforementioned facts and circumstances, the period of custody and also that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Sangrampur G.R. No. 2357 of 2016 arising out of Kuchaikot P.S. Case No. 161 of 2016.
