2. The petitioners have preferred this application for grant of regular bail in connection with Shivajinagar P.S. Case No. 54 of 2024 dated 11.04.2025 registered for the offences punishable u/ss 126(2), 115(2), 118(1), 109, 303(2), 352 and 351(2) read with section 3(5) of the BNS.
3. As per the prosecution case, the petitioners and the co-accused persons along with the other 10 unknown miscreants armed with various weapons are alleged to have come to the door of the informant and, in the meantime, Shivnath Ray and
Patna High Court CR. MISC. No.39212 of 2025(2) dt.07-07-2025 2/3 Sanjit Ray assaulted the informant with iron rod on his head with intention to kill causing severe injury to him, thereafter, Sanjit Ray assaulted with the butt of pistol. It is further alleged that Ram Sagar Ray snatched golden Hanumani Chakti worth Rs. 15,000/- and Devtara Devi took out Rs. 1500/- from his pocket. When one Santosh Kumar Ray came to rescue, they also assaulted him with lathi, danda and iron rod causing injury to him.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. As per the injury report, the injured sustained simple injury caused by hard and blunt substance. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 11.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.39212 of 2025(2) dt.07-07-2025 3/3 learned Court concerned, Rosera, Samastipur in connection with Shivajinagar P.S. Case No. 54 of 2024.
7. The application stands allowed.
