2. The petitioner makes a prayer for bail in connection with Mufassil (Chapra) P.S Case No.07 of 2025 registered for offences under Section 115(2), 118(1), 109, 126(2), 303(2), 352, 351(2) and 3(5) of the B.N.S.

As per the prosecution case, the six named accused persons including the petitioner came variously armed and intercepted the informant's cousin Kallu Kumar on Makhdumganj chauk on account of an earlier dispute and on protest raised by the informant, the accused Arvind Chaudhary (the petitioner) and Pawan assaulted the informant with Dabiya due to which he sustained injuries on the right side of the

4. Learned counsel for the petitioner submits that there is a dispute between both the parties and a free fight took place causing injuries on both sides. A case has been filed on behalf of the present petitioner being Mufassil P.S. Case No.07 of 2025 against the informant and Kallu Kumar for the same occurrence. The injury report of the injured has also been annexed as Annexure-P2 to the present application, which would show that the injuries sustained by the informant and Kallu Kumar are simple in nature. The petitioner is in custody since 12.02.2025 and undertakes to cooperate in the investigation/trial.

5. Learned APP for the State opposes the prayer for bail application on the ground that there are six criminal antecedents, however, it has been submitted that the said antecedents are under the Excise Act and he is on bail in all the said cases.

6. Taking into consideration the facts and circumstances, the petitioner is enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Court of C.J.M., Saran at Chapra, in connection with Mufassil (Chapra)

(ii) the petitioner would appear before the learned Court below on each and every date till the charges are framed and if the petitioner does not appear on any date without any substantial and satisfactory reason, the learned Court below would be at liberty to cancel his bail bonds.
