JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-05-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Motihari Town P.S. case no. 528 of 2017 for the offence under Section 386 of the Indian Penal Code.

From the F.I.R., it appears that there is specific allegation against one Dipak Paswan that he has demanded Rangdari on the mobile number of the informant. It appears that the name of the petitioner surfaced on the confessional statement of said Dipak Paswan. Learned counsel submits that similarly circumstanced other accused, namely, Munna Pathak @ Krishna Kumar Pathak, has been granted bail in Cr. Misc. No. 11361 of 2018 vide order dated 30.03.2018.

Considering the aforesaid, the petitioner, named

Patna High Court Cr.Misc. No.22605 of 2018 (3) dt.17-05-2018 2/2 above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the amount each to the satisfaction of Chief Judicial Magistrate, Motihari in connection with Motihari Town P.S. case no. 528 of 2017 with the condition that the bailors should be the family members of the petitioner.
