JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 27-06-2025 Learned counsel for the petitioners seeks permission to withdraw the application with regard to petitioner nos.2 and 3 and he submits that petitioner nos.2 and 3 will surrender before the court concerned.

3. Accordingly, the application with regard to petitioner nos.2 and 3 is dismissed as withdrawn.
4. Heard learned counsel for petitioner no.1, namely, Saukat Raja and learned A.P.P. for the State.
5. Petitioner no.1 apprehends his arrest in connection with Balrampur P.S. Case No.28 of 2025 instituted under Sections
Patna High Court CR. MISC. No.40238 of 2025(2) dt.27-06-2025 2/3 126(2), 115(2), 117(2), 74, 352, 351(2), 3(5) of the B.N.S.
6. As per prosecution case, the named accused persons including petitioners assaulted the informant and her husband with lathi, danda, rod and spade. Petitioner nos.2 and 3 are alleged to have assaulted the husband of the informant causing fracture on his leg.
7. Learned counsel for petitioner no.1 submits that the petitioner is innocent and has falsely been implicated in this case. There is land dispute between both the parties. The injury upon the informant is found to be simple in nature. Both parties are close relatives. Petitioner no.1 has no criminal antecedent and he undertakes to cooperate in the investigation and the trial.
8. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
9. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, petitioner no.1, namely, Saukat Raja be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Katihar in connection with Balrampur P.S. Case No.28 of 2025, subject to the conditions as laid down
