Earlier, the application for bail of the petitioner was rejected along with three other co-accused persons. It is contended that out of them, two others, namely, Ram Pravesh Yadav and Deba Mukhiya @ Debba Mukhiya have been granted bail by different Benches of this Court vide orders dated 03.10.2016 and 06.10.2016 passed in Cr. Misc. No.42286 of 2016 and Cr. Misc. No. 41721 of 2016 respectively. It is contended that charges have already been framed in the case and the trial is not likely to be concluded in
Patna High Court Cr.Misc. No.49148 of 2016 (2) dt.30-11-2016 2 / 2 near future.
Learned counsel for the State concedes that the case of the petitioner stands on identical footing to that of the co-accused Ram Pravesh Yadav and Deba Mukhiya @ Debba Mukhiya.
In that view of the matter, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Bettiah, West Champaran in connection with Sessions Trial No. 97 of 2016 arising out of Bettiah Muffasil (Manuapool) P.S. Case No. 404 of 2015.
