Considering the quantum of recovery of foreign liquor of Indian origin, prayer for bail of petitioner was rejected vide order dated 14.12.2016 passed under Cr. Misc. No.48498 of 2016, giving a liberty to renew after framing of charge. From Annexure-3, it is evident that charge had already been framed on 30.03.2017.

Accordingly, petitioner, Tinku Sao @ Tinku Kumar Sao @ Tinku Kr. Sao @ Bhola Sao is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in

Patna High Court Cr.Misc. No.21780 of 2017 (02) dt.10-05-2017 connection with Barachatti P. S. Case no.319 of 2016, subject to condition that learned lower Court before acceptance of bail bond will verify the identity as well as soundness of bailors, so that petitioner, who is resident of different state, should remain present during the trial.
