JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2015 Learned counsel for the petitioner is permitted to make necessary correction in the petition, as prayed for. Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379/511 of the Indian Penal Code.

It is alleged that one Rajan alias Chhotu was caught while trying to steal the motorcycle of the informant who subsequently disclosed the name of the petitioner. It is submitted by the learned counsel for the petitioner that the specific case of the informant in the FIR is that co accused Rajan was only found making an attempt to steal the motorcycle but only on confession of Rajan at belated stage the petitioner has

Patna High Court Cr.Misc. No.26911 of 2015 (2) dt.03-07-2015 2/2 been roped in the present case. The FIR was only registered against co accused Rajan which suggests that Rajan while caught on spot did not make any confession. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Samastipur (T) P.S. Case No. 194 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
