JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. C-1/1740/2013 in which cognizance has been taken for the offences punishable under Sections 498A/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act. Admittedly, petitioners no. 1 and 2 are parents in law whereas petitioner no. 3 is married nanad of opposite party no. 2. It would appear from perusal of solemn affirmation of the opposite party no. 2 that it was husband of opposite party no. 2 who created all the problems and she has not even whispered against the petitioners in her above stated statement.
Patna High Court Cr.Misc. No.600 of 2015 (2) dt.08-01-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Sitamarhi Sadar, Sitamarhi in Complaint Case No. C-1/1740/2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
