JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in Complaint Case No.3350 (C) of 2013 instituted for the offence under Section 498'A' of I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution case, in brief, is that marriage of the complainant was solemnized with the petitioner on 24.6.2011. Thereafter the accused persons started demanding money from the father of the complainant despite gift worth Rs.3,50,000/- as well as Scarpio was given to the petitioner. After1to 1⁄2 months the complainant was subjected to mentally and physically torture on

Patna High Court Cr.Misc. No.28743 of 2015 (2) dt.23-07-2015 2/2 account of non-fulfillment of their demand. It is further alleged that the complaint was ousted from her matrimonial house. It has been submitted on behalf of the petitioner that the petitioner is ready to keep the complainant but the same is not acceptable to her. It is further submitted that the petitioner is ready to deposit Rs.1000/- per month before the lower court which shall be released in favour of complainant.

On behalf of the State it is submitted that the petitioner is named in the complaint petition. Considering the aforesaid facts and circumstances and on depositing Rs.1000/- per month before the court below in favour of the complainant, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Patna, in Complaint Case No.3350/13 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
