JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P.for the State.

The application is for grant of bail for the offence under Sections 302, 34 and 120(B) of the Indian Penal Code. It is submitted on behalf of the petitioner that except the confessional statement, there is nothing against the petitioner. It is further submitted that the co-accused (Krishna Kumar @ Kishan @ Kishan Kumar), from whose possession a country-made Pistol was recovered, has been granted bail by this Hon'ble Court, vide order dated 9.5.2016 passed in Cr. Misc. No.20091 of 2016, and the petitioner is languishing in custody since Heard leaned A.P.P. also, who does not controvert the aforesaid facts.

No.48040 of 2016 (3) dt.19-12-2016 2/2 Having heard both sides and in view of the facts as stated above as well as considering the similar allegation against the co-accused, Krishna Kumar, who has been granted bail by this Court, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Sitamarhi in connection with Majorganj (Suppi O.P.) P.S.Case No.11 of 2016, with a condition that he will co-operate in the trial of the case and will make available himself on each and every date, if required, otherwise his bail bond may be cancelled.
