JUSTICE RAKESH KUMAR ORAL ORDER 26-04-2017 Heard Sri Ashok Kumar Jha, learned counsel for the petitioner and learned Additional Public Prosecutor. This is second attempt for grant of bail on behalf of the petitioner. Earlier, prayer for bail of the petitioner was rejected on 21.10.2016 vide Cr. Misc. No. 43064 of 2016 . The petitioner is in custody in Pupri P.S. Case No. 129 of 2016 registered for the offence under Section 409, 420 of the Indian Penal Code.

It was submitted by learned counsel for the petitioner that petitioner is in custody since 08.08.2016 and offences for which the petitioner has been charge -sheeted are triable by

Patna High Court Cr.Misc. No.20496 of 2017 (2) dt.26-04-2017 2/2 Magistrate Court.

Considering the period of custody as well as the fact that case is triable by Magistrate, let the petitioner Gajendra Pathak be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate , Pupari at Sitamarhi / concerned court in connection with Pupri P.S. Case No. 129 of 2016.
