The petitioner is apprehending his arrest in connection with Trial No.2234 of 2019 arising out of Complaint Case No.C1617 of 2018, registered for offences punishable under Sections 498(A) of the Indian Penal Code and Section 3⁄4 of the D.P.Act. Case is under Section 498(A) of the IPC and as per direction of this Court, vide order dated 18.6.2019, both the parties are present in the court and it is submitted that now the dispute between the parties has been settled and they re residing together.

Heard learned A.P.P. also.

No.37164 of 2019(3) dt.05-07-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM Sadar, East Champaran, Motihari in connection with Trial No.2234 of 2019 arising out of Complaint Case No.C-1617 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with condition that the petitioner shall keep his wife with dignity and care, otherwise, his bail bond shall be cancelled.

With the aforesaid direction, this application is allowed.
