Petitioner No. 3 being husband of the victim and petitioner Nos. 1 and 2 being co-villager and brother of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
The accusation is killing the daughter of the informant after two years of marriage for non-fulfilment of dowry demand.
It is submitted by learned counsel for the petitioners that accusation is not specific particularly against petitioner Nos. 1 and 2. It is further submitted that parents of the husband of the victim have been granted anticipatory bail by a Coordinate Bench of this Court vide Cr. Misc. No. 25988 of
Patna High Court Cr.Misc. No.29316 of 2015 (2) dt.28-07-2015 2/2 2015.
Considering the accusation being specific against petitioner No. 3 being husband of the victim, this Court is not inclined to grant privilege of anticipatory bail to the petitioner No. 3. The prayer for anticipatory bail of petitioner No. 3 is rejected.
So far as petitioner Nos. 1 and 2 are concerned, since there is no specific accusation against petitioner Nos. 1 and 2, let the petitioner Nos. 1 and 2, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Dumariya P.S. Case No. 19 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
