JUSTICE SANJAY PRIYA ORAL ORDER 19-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Basantpur P.S. Case No. 331 of 2014 instituted for the offence under Sections 406, 420, 465, 467, 468 and 471/34 of the Indian Penal Code. As per complaint petition, it is alleged that petitioner being a Proprietor of National Services having its office at Siwan, induced various depositors to deposit the amount in the company. It is alleged that informant deposited Rs.49,000/- and Rs. 51,000/- by cash in the account of the accused persons as mentioned in the complaint petition. The complainant again deposited a sum of Rs.1,00,000/- by cheque which was encashed in the ICICI Bank at Siwan in the account of petitioner. He also
Patna High Court Cr.Misc. No.54874 of 2016 (6) dt.19-05-2017 2/2 deposited amount of Rs.17,000/- in account of petitioner under recurring deposit scheme but he has not received any interest. He received interest only for eight months amounting to Rs.32,000/- and, thereafter, the petitioner stopped making payment of the amount of interest and also did not refund the principal amount and fled away after closing the company.
It is mentioned in paragraph-3 of the bail petition that several depositors have also filed case against the petitioner. In such circumstances, this Court does not find it a fit case for grant of bail to the petitioner at this stage. Prayer for bail of the petitioner stands rejected. (Sanjay Priya, J) S.Ali/- U T
