The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, there are two place of occurrence. From the first place of occurrence 35 litres of country liquor and 3000 litres of raw jawa and from the second place of occurrence 25 litres of country liquor and about 1400 litres of raw jawa was recovered. On inquiry it transpired that the petitioner was concerned with the second place of occurrence.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. He has been falsely implicated in the
Patna High Court CR. MISC. No.51121 of 2021(2) dt.24-02-2022 2/2 case. He is in custody since 1.6.2021 and has no criminal antecedent.
The application for bail is opposed by learned APP for the State who submits that charge has been framed against the petitioner on 4.8.2021 and the trial has commenced. Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Ganga Bridge P.S. Case no. 19 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge IIcum-Excise Court, Vaishli at Hajipur. (Partha Sarthy, J) Prakash/- U
