20-10-2016 Heard Sri Diwakar Prasad Karn, learned counsel for the petitioner and Sri Murlidhar, learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Sakra P.S. Case No. 124 of 2016 registered for offence under Sections 366/34 of the Indian Penal Code, has prayed for grant of bail. By way of referring to F.I.R., learned counsel for the petitioner submits that informant herself has stated in the F.I.R. that till 4-5 months from the date of occurrence, she was requesting the petitioner to return the victim girl, but since it was refused, finally, an F.I.R. was lodged. He submits that in the F.I.R. itself, it was indicated that on 04-12-2015, while daughter of the informant had gone to appear in an examination in Samastipur Mahila Mahavidyalaya, she was kidnapped by the petitioner and

Learned counsel for the petitioner has drawn my attention to Annexure - 3 to the petition to show that the victim had solemnized marriage with the petitioner and she was living peacefully with the petitioner, however; subsequently on pressure, the case was lodged and under influence of the informant, statement under Section 164 of the Cr.P.C. was got recorded showing implication of the petitioner. It is also admitted that victim girl was aged about 20 years.

In view of facts and circumstances, particularly; the fact that informant herself has lodged F.I.R. after 4-5 months from the date of occurrence, the Court is of the opinion that it is a case for grant of bail.

Let the petitioner namely Sunny Kumar @ Sanyog Kumar Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge 13th-cum-A.C.J.M., Muzaffarpur in connection with Sakra P.S.
