The petitioner is apprehending his arrest in connection with Forbesganj P.S. Case No. 331 of 2014 for the offences instituted under Sections 376 of the IPC and 3⁄4 of the D. P. Act. The prosecution story, in brief, is that five months before from the date 16.07.2014, accused Firoz called the informant for manure in his Maize field and she was alone and finding alone, accused Firoz forcibly committed rape with her and thereafter he promised to marry with her and thereon he continued bodily relation with her and suddenly on 20.06.2014 she felt pain in the abdomen, when she was brought in the Referral Hospital,

Patna High Court Cr.Misc. No.27047 of 2015 (3) dt.09-09-2015 2/2 Forbesganj, by her parent for medical check-up the matter came to light that she was pregnant about four months. She further alleged that Md. Firoj denied to marry with the informant Tarannum. It has been submitted on behalf of the petitioner that the petitioner and the informant have already married and leading conjugal life. Taking into the said fact, now there is no dispute between the parties.

On behalf of the State it has also been submitted that it has come in paragraph no. 46 of the case diary that the petitioner and the informant are leaving together.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Forbesganj P.S. Case No. 331 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
