The petitioner seeks bail in connection with Jaynagar P.S. Case No. 58 of 2018 for the offences punishable under Sections 420 of the Indian Penal Code and Sections 103/104 of the Indian Trade Mark Act, 1999 read with Sections 63 and 65 of the Copy Right Act.

The allegation against the petitioner is regarding preparation of duplicate Dabur Gulabari of Dabur Company and 748 pieces of 50 ml. bottles of Dabur Gulabari, 115 pieces of empty bottles of Dabur Gulabari as well as 9220 stickers of Dabur Gulabari were recovered.

The learned counsel for the petitioner submits that it has not been found till date as to whether the Dabur Gulabari

Patna High Court Cr.Misc. No.24083 of 2018 (4) dt.03-07-2018 2/2 seized from the premises of the petitioner is fake or not. It appears that no efforts have been made by the Police to verify the authenticity of the said Gulabari. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 03.2.2018. The learned counsel for the petitioner further submits that the petitioner is ready to deposit a sum of Rs. 50,000/- subject to result of this case for the purposes of grant of bail.

Having regard to the facts and circumstances of the case, I direct the petitioner, above named, to deposit a sum of Rs. 50,000/- with the Nazarat of the concerned court within a period of four weeks from today and upon showing the receipt of the same, the learned trial court / concerned court shall release the petitioner on regular bail subject to such condition(s) as it may deem fit and proper.

The application is disposed of accordingly.
