JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Manihari PS case no. 466 of 2017 instituted for the offences punishable under Sections 363, 366 of Indian Penal Code. The allegation is regarding the husband of the informant being abducted by the main accused namely Mohan Thakur and 10-11 unknown gang members of the said Mohan Thakur for ransom and lateron, the dead body of the husband of the informant was recovered.

The learned counsel for the petitioner submits that the petitioner is a non-FIR named accused person and his name has transpired subsequently, during the course of investigation and

It is further submitted that similarly situated co-accused person namely Md. Jamshed Alam has already been granted bail by this Court vide order dated 10.05.2018 passed in Cr. Misc. no. 15133 of 2018. The petitioner is said to be languishing in custody since 06.02.2018.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Swati Kumari, 8th Judicial Magistrate 1st class, Katihar in connection with Manihari PS case no. 466 of 2017.
