1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. The petitioner has renewed his prayer for regular bail.
3. This application, for grant of regular bail, arises out of Pakridayal Police Station Case No. 312 of 2019, dated 03.10.2019, disclosing offences under Section 394 of the Indian Penal Code.
4. The prosecution case as per the FIR is that four persons riding on two motorcycles intercepted the informant and looted a sum of Rs. 2,50,000/- from him.
5. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.40057 of 2025(3) dt.25-07-2025 2/3 while rejecting the bail application of the petitioner on 22.01.2025, this Court granted liberty to renew his prayer for bail after three months if the trial does not show any progress. The trial has not proceeded further from the date of last rejection of the bail application of the petitioner.
6. This Court had called for a report from the learned Trial Court on 27.06.2025. In pursuant thereof, the report has been submitted by learned Additional District & Sessions JudgeII, East Champaran, Motihari, stating therein that out of five witnesses named in the charge-sheet, none of them have been produced by the prosecution before the Trial Court. Petitioner is in custody since 20.09.2024.
7. Regards being had to the submissions made by the parties, taking into account the fact that the petitioner is in custody since 20.09.2024, this is his second attempt for bail and the trial has not progressed much after the last rejection, I am inclined to grant regular bail to the petitioner.
8. This application is, accordingly, allowed.
9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional District & Sessions Judge-II, East

10. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
