NILU AGRAWAL ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is languishing in judicial custody since 29.09.2016 in connection with Muffasil P.S. Case No. 448 of 2016 for the offences alleged under Sections 272, 273 of the Indian Penal Code and 47(A) of the Excise Amendment Act. The prosecution case as lodged by the police party is that during patrolling they seized 60 liters of mahua wine from the house of petitioner.
It has been submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated in the aforesaid case along with other co-accused Pappu Choudhary, who used to bring the illegal mahua wine from Jharkhand and that the petitioner has no criminal antecedent. Learned A.P.P. for the State submits that the
Patna High Court Cr.Misc. No.50154 of 2016 (2) dt.24-11-2016 petitioner is named in the First Information Report, hence opposes the prayer for bail.
From the materials available and considering the period of custody, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Muffasil P. S. Case No. 448 of 2016.
