JUSTICE BIRENDRA KUMAR ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 399, 402, 414 and 120B of the Indian Penal Code, Sections 25(1-B)a/26(i)/35 of the Arms Act and Sections 20 and 22 of the NDPS Act. Later on Sections 25(1-A) and 25(1-AA) was also added.

A country made loaded pistol was recovered from the possession of this petitioner. The petitioner has stated on oath that he has got no criminal antecedent and he is in custody since 13.10.2016.

Considering the entire facts aforesaid, let petitioner, above named, be enlarged on bail on completion of nine months of

Patna High Court Cr.Misc. No.20598 of 2017 (2) dt.02-05-2017 custody on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Spl. Judge, Muzaffarpur/Successor Court, in connection with Maniyari P.S. Case No.193 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
