2. The petitioner seeks regular bail in connection with Rosera P.S. Case No. 210 of 2023, registered for the offence punishable under Sections 363, 366A/34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As per prosecution case, the petitioner is said to have eloped with the minor girl. After recovery, the girl has been examined and she has been found to be 17 years years old. Petitioner is in custody since 16.03.2023.

4. Learned APP has vehemently opposed the prayer for bail.

5. Considering the nature of allegation and period of custody, this application is allowed.

6. Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-1, Rosera, Samastipur in connection with Rosera P.S. Case No. 210 of 2023.

7. The petitioner will give an undertaking in the trial court that he will not threatened any of the family members of the girl or any of the witnesses, if such a complaint is filed by the prosecution, the bail bond of the petitioner shall be cancelled.
