The petitioners apprehend their arrest in Trial No. 7573 of 2014, arising out of Complaint Case No. C313 of 2014, registered for the offences punishable under Sections 420, 467, 468, 471, 323, 506 and 34 of the Indian Penal Code. The complainant made allegation that the petitioners fraudulently got the sale deed executed with regard to Khata No. 17, Khesra No. 392 from her brother. The complainant claimed that the lands belong to her mother who inherited the property from her father.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.1316 of 2015 (2) dt.13-01-2015 petitioners are cousin of the mother of the complainant. The sale deed is said to have been executed by the brother of the complainant. The dispute appears to be of civil nature. Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sadar at Motihari in connection with Trial No. 7573 of 2014, arising out of Complaint Case No. C313 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
