JUSTICE BIRENDRA KUMAR ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 384, 386, 387, 388, 120(B)/34 of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act.

Allegation is that a group of extremist came at the brickklin of the informant, demanded ransom and threatened of dire consequences in the event of non-payment of the same. Further allegation is of snatching the mobile phone. Petitioner is accused in other cases also.

Submission of the petitioner is that this is a matter of police atrocity. The petitioner and others are being falsely implicated in every unknown case wherein petitioner is already on bail. There is no other material against the petitioner nor the petitioner was

Patna High Court Cr.Misc. No.41898 of 2016 (6) dt.13-02-2017 2/2 identified even by the informant. The petitioner is in custody since 30.04.2016.

Considering the nature of allegation and the period already undergone by the petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya/successor Court in connection with Main (Pai-Bigha O.P.) Police Station Case No. 05 of 2016, subject to the condition that one of the bailors shall be the government servant or the local servant.
